Acceptable Use Policy

This Acceptable Use Policy (“AUP”) is incorporated into and made a part of the Sardius Media Platform General Terms and Conditions (“Terms and Conditions”) and use of the Sardius Service (as defined therein) is subject to, and conditioned upon, compliance with this AUP. The prohibited conduct in this AUP is not exhaustive. This AUP may be updated by Sardius from time to time upon reasonable notice, which may be provided via your account, e-mail, or by posting an updated version of this AUP at https:/www.sardius.media/acceptable-use-policy.

You must not use the Service for any purposes beyond the scope granted in our Terms and Conditions. You will be responsible for all end users and activities conducted under your Sardius Media Platform account and logins. Sardius may immediately suspend or terminate your access to the Sardius Services if Sardius determines you have violated this AUP.

You must comply with, and cause your end users to comply with, the following terms when using the Sardius Services:

  1. Sardius Services may not be used in any jurisdiction for misleading, deceptive, unlawful, obscene, offensive, or fraudulent content or activity. Examples of prohibited activities include:

  1. a. advocating or causing harm or using Sardius Services to stalk, harass, bully, or post direct, specific threats of violence against others;

  2. b. interfering with or violating the integrity or security of a network or system;

  3. c. evading filters; sending unsolicited, abusive, or deceptive messages;

  4. d. introducing viruses or harmful code;

  5. e. violating third party rights;

  6. f. streaming content that would constitute offensive speech;

  7. g. misrepresenting yourself, or disguising the origin of any content (including by “spoofing”, “phishing”, manipulating headers or other identifiers, impersonating anyone else);

ii. Sardius Services may not be used to upload, stream or otherwise transmit Licensee Data that is  (a) indecent, obscene, sexually explicit, pornographic, defamatory, libelous, harassing, threatening, abusive, hateful, or violent; (b) contains fraudulent, false, deceptive, or misleading offers, statements, claims or representations; (c) depicts, promotes, or encourages serious harm or any form of violent, illegal,  tortious, or dangerous conduct; or (d) contains viruses, bots, worms, scripting exploits, or other similar materials.

iii. Sardius Services may not be used in any manner that would infringe, dilute, misappropriate or otherwise violate a third party’s privacy, publicity, or other personal and intellectual property rights.

iv. Sardius Services are only to be used for authorized and lawful purposes, consistent with all applicable laws and regulations and the rights of others.

Sardius reserves the right to take, or refrain from taking, action in its discretion. Without affecting any other remedies available to us, Sardius may permanently or temporarily remove or disable access to unacceptable content, or terminate or suspend access to the Sardius Services, without notice or liability if Sardius determines there has been a violation of this AUP.
